The latest ruling does not directly impact you or your 2019 health insurance coverage. The judge ruled that the Affordable Care Act (ACA) is unconstitutional, BUT this case may move up to higher courts (federal appellate court and Supreme Court) and this may not happen until later in 2019 or early 2020.
What did the Judge rule?
The Judge ruled that the ACA is unconstitutional because of the decision to remove the individual mandate penalty in 2019. According to the Judge, the individual mandate penalty is central to the law and the ACA cannot operate without it.
Is my healthcare coverage safe after the Texas ACA court decision?
Yes, your health insurance coverage is safe and we expect that to continue into 2019. The Judge’s ruling does not bar the enforcement of the ACA, which is great news for our members.
What will happen next?
There are other states who are defending the ACA and they will likely go to the federal appellate court that presides over the state of Texas. This court will either uphold the Judge’s decision or overturn the Judge’s decision. Then the case could be presented to the Supreme Court.
When might changes to the ACA take place?
It will take time for this case to work its way through the court system. We want you to know your coverage is currently safe. While we cannot be certain how long this process will take, it’s important that you maintain your health insurance coverage and continue to pay your monthly premiums to continue using your benefits.
